Terms and Conditions of Sale

1. General provisions

1.1. Definitions. "Seller": ESHOP di Elena Stragliotto, with registered office at via Santa Giuliana 8, 20835 Muggiò (MB), VAT No. 10258290963, who enters into the sales contract with the Buyer through the Idroponica Facile website. "Consumer": the Buyer who purchases outside of any professional or business purpose. "Product" or "Products": the goods offered for sale on the Site.

1.2. These terms apply to any order and shipment of Products made through the Site, except where mandatory rules conflict with these terms, provided that delivery is foreseen within the territory served by the Seller. They do not apply to third-party sites, to which the relevant terms apply.

1.3. Before making a purchase, please read these terms carefully. By placing an order through the Site you agree to be bound by them. Otherwise it will not be possible to order the Products.

2. Purchase of a Product and order processing

Once the order steps are completed, you will receive an order confirmation at the email address provided. Further communications will update you on the order status. The order is accepted when we proceed to ship the Product, notifying you accordingly. Should we be unable to fulfil the order (e.g. unavailable Products), you will be informed by email or telephone. The Seller may refuse orders that contain obvious pricing errors or inaccuracies; in such cases any amounts paid will be refunded.

3. Buyer's requirements and obligations

By placing an order, you declare that you are at least 18 years old, or the minimum legal age applicable in the country of purchase, and that you are providing truthful and complete information.

4. Price and characteristics of Products

Prices are shown on the Site. Additional and shipping charges are displayed in the summary before purchase. Discounts or promotions apply where provided. Images are for illustrative purposes only and may not be perfectly representative of the Product.

5. Payment methods

Payments are made using the methods indicated on the Site and may vary depending on the country. In case of withdrawal, the same payment method used for the original order will be used, unless otherwise agreed.

6. Shipping and delivery information

Products will be delivered to the address provided at the time of the order, provided it falls within the territory served. Any restrictions or special conditions will be indicated at checkout or communicated after order confirmation. You are responsible for the accuracy of the data entered; errors in the delivery details may prevent delivery without any liability on the Seller's part.

The estimated delivery date depends on the shipping method selected and will be indicated as above. In the event of inability to deliver, you will be contacted as soon as possible.

For any issues related to shipping, please contact the Seller through the Contact Us section. A signature may be required upon delivery; if the package appears damaged, we invite you to refuse delivery or to accept it with reservation ("package not verified"). The absence of reservations may affect warranty claims against the carrier.

7. Transfer of ownership and risk

Risk and ownership of the Products are transferred to the Buyer at the time of delivery.

8. Right of withdrawal

If you purchase as a consumer, you are entitled to withdraw from the contract within 14 (fourteen) days from the day on which you or a third party designated by you (other than the carrier) acquires physical possession of the goods, without having to provide any reason and without penalty, pursuant to Articles 52 et seq. of Italian Legislative Decree 206/2005 (Consumer Code).

How to exercise the right of withdrawal

To exercise the right of withdrawal, send an explicit statement (e.g. by post or email) containing your order reference, the products for which you intend to withdraw and your identifying details. You may use the model withdrawal form (not mandatory).

The deadline is met if the communication is sent before the 14-day period expires. After notifying us of your withdrawal, you must return the goods within 14 days of the notification, according to the instructions we will provide by email.

Effects of withdrawal

In the event of withdrawal, we will refund all payments received from you, including the initial standard delivery costs (any supplementary costs arising from your choice of a delivery method other than the least expensive standard delivery we offer are excluded), within 14 days of the day on which we receive the returned goods or proof of their shipment, whichever occurs first (Art. 56 Consumer Code). The refund will be made using the same payment method you used, unless otherwise agreed.

The return shipping costs are at your expense, unless otherwise indicated on the product page or during ordering. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning (Art. 57, par. 2).

Condition of returned goods

• Goods must be intact, complete with all their parts and accessories, manuals and original undamaged packaging.
• For assembly kits: the return is accepted if the kit is intact and unused; assembly, use with water/nutrients or installation of components may result in a diminished value up to potential non-refundability if no longer resellable as new.

Exceptions to the right of withdrawal (Art. 59 Consumer Code)

The right of withdrawal is excluded for the goods listed below, to the extent they concern our offering:

• Bottles of nutrients, pH adjusters and technical solutions (e.g. pH Down, Flora series, etc.) if opened after delivery or if the seal has been broken, for hygiene/health and safety reasons.
• Seeds if the packaging has been opened or the seals removed, or if the seeds have been sown/hydrated (goods no longer suitable for resale and subject to rapid deterioration).
• Substrates and loose materials (e.g. rock wool, perlite, vermiculite, expanded clay) if the packaging has been opened or the seal removed, for hygiene reasons.

Damaged or non-compliant goods

Without prejudice to the rights provided by the statutory warranty of conformity (Articles 128–135-septies Consumer Code) for defective or non-compliant products.

The right of withdrawal applies exclusively to customers who purchase as consumers, that is, natural persons acting for purposes unrelated to any entrepreneurial, commercial, craft or professional activity they may carry out.

Purchases made by professionals or businesses (identified by VAT number) do not fall within the scope of the right of withdrawal provided by the Consumer Code (Italian Legislative Decree 206/2005), but will still be handled case by case with the utmost good faith and common sense.

10. Refund policy following withdrawal from the order

Before delivery: refund within 14 days of the withdrawal notification, using the same payment method.

After delivery: you must return the Products within 30 days of delivery following the instructions sent by email. Return shipping costs are at your expense. The refund will be issued within 14 days of the withdrawal notification, with the Seller's right to withhold the refund until receipt of the goods or until the Buyer demonstrates that they have been shipped.

Except for defects or faults, withdrawal is not allowed for personalised or clearly custom-made Products. Products that have been tampered with or used beyond what is necessary to establish their nature, characteristics and functioning are non-refundable.

11. Warranty and after-sales support

Any shortages, damage or defects found upon delivery must be reported promptly. All Products sold on the Site are guaranteed free from faults and defects.

Without prejudice to applicable mandatory rules, the Products are covered by the statutory warranty of conformity for 2 years from delivery for Consumer purchases, under the conditions of the law. 12. Limitations of liability

• improper use or tampering with the Product by the Buyer;
• regulatory breaches in import/export carried out by the Buyer;
• indirect damages or loss of profits due to delays or impossibility of delivery;
• sales made on third-party sites linked through hyperlinks.

These limitations neither exclude nor limit the Consumer's mandatory rights.

13. Data protection and Privacy

The processing of personal data is carried out as described in the Site's Privacy Policy.

14. Contract archiving

The Seller stores concluded contracts in digital format in accordance with security and confidentiality criteria. Customers may request a copy through the Contact Us section.

15. Applicable law and jurisdiction

15.1. Save for any different mandatory rules applicable in the Consumer's country, contracts concluded through the Site are governed by Italian law.

15.2. Save for different mandatory jurisdiction, the court of the place of residence or domicile of the Consumer has exclusive jurisdiction.

15.3. Disputes may be submitted to the European ODR Platform: ec.europa.eu/consumers/odr.
